DIAMOND JUBILEE INSTAGRAM GIVEAWAY
1. ELIGIBILITY AND PARTICIPATION
i. To be eligible to enter the Contest, an individual (hereinafter the “Participant”) must:
a. Be a real person at least 21 years old,
b. Be a legal resident,
c. Have a valid passport for travel.
ii. Employees of Sofitel Fiji Resort & Spa, its subsidiaries, and their respective family members are not eligible to participate in the Contest.
iii. The Contest is void where prohibited by law.
2. ENTRY PERIOD
i. The Contest will be open at 12pm FJT Friday 5th April to 12pm FJT Wednesday 17th April 2024.
ii. The dates and times indicated in these rules refer to Fiji Time Zone (UTC+12).
iii. No other time zone will be taken into account for participation in the Contest.
3. KNOWLEDGE AND ACCEPTANCE OF THE RULES
i. These rules govern the implementation of the Contest and the selection of the winners. Each Participant acknowledges having read the rules in their entirety and the principles of the Contest and accepts the conditions therein.
ii. Participation in this Contest shall be deemed to imply full and complete acceptance by the Participant of all the terms and conditions specified in these rules, the applicable online code of conduct, and the applicable laws and regulations regarding contests.
iii. Failure to comply with the any of the provisions of these rules will invalidate participation. This Contest is accessible from Instagram, and each Participant must therefore also comply with the terms of use of Instagram. The Participant also acknowledges the privacy policy of Instagram. However, this Contest is not managed, certified or sponsored by Instagram.
4. HOW TO PARTICIPATE
i. To enter this Contest, each person (Participant) must:
a. Follow @sofitelfiji on Instagram,
b. Like the Contest announcement post on Sofitel Fiji’s Instagram account,
c. Comment why you would like to attend the Diamond Jubilee celebrations in Fiji, where you would like to be flown from, and tag who you would take with you.
ii. Each private individual can only enter once.
iii. Entries must be received by 12pm FJT on Wednesday 17th April 2024 to be eligible for the Contest.
iv. Any entries received after the closing of the Entry Period will be invalid and will not be entered into the Contest.
v. Any incomplete, erroneous, falsified information or information that does not allow the Participant to be identified or located will result in the cancellation of his/her participation. Thus, Sofitel Fiji Resort & Spa reserves the right, at its sole discretion, to exclude from the Contest any Participant who does not comply with one of the conditions of these rules.
5. SELECTION OF WINNERS
i. On or after 12pm FJT 17th April 2024, three (3) winners will be selected from all eligible entries based on:
a. Relevance & creativity of the Participant’s answers,
b. Participant has met the competition criteria.
ii. Winners will be notified via Instagram on Friday 19th April 2024.
iii. Sofitel Fiji Resort & Spa reserves the right to appoint a third party to verify Application winners and fulfil the delivery of prizes. Participants agree that the sponsor may provide all necessary information about Application winners to such a third party to facilitate such service.
iv. The decision of Sofitel Fiji Resort & Spa will be final and binding.
6. NOTIFICATION OF SELECTED WINNER
i. Sofitel Fiji Resort & Spa will notify the Winners through a direct message or comment on the social media platform used to share the winning entry (Instagram) on 19th April 2024.
ii. Upon nomination, the Participant will be asked to provide the necessary personal information to organize the prize giving: Email address, phone contact, full names of winner & travel companion, passport details etcetera.
iii. If a selected Winner does not respond or fails to claim their prize within 7 (seven) days after notification or attempted notification by Sofitel Fiji Resort & Spa, they will be disqualified, and Sofitel Fiji Resort & Spa may select another Winner from the selection procedure set out above.
iv. The names of the winners will be available from Sofitel Fiji Resort & Spa.
7. PRIZES
i. The prize package includes:
a. 2 x invites to Sofitel Fiji Resort & Spa’s VIP Diamond Jubilee event on Wednesday 26th June,
b. 2 x Return Fiji Airways flights from choice of Sydney, Melbourne, Brisbane, Canberra, Adelaide, Auckland, Christchurch or Wellington to arrive in Fiji on Monday 24th June 2024 and depart Fiji on Thursday 27th June 2024 back to same port of departure. Sofitel Fiji Resort & Spa reserves the right to modify or delay the use of the tickets at any time. Flight tickets include 1 x piece of checked luggage per person up to the weight of 30kg. All economy fares include meals, beverages, inflight entertainment, and 1 x carry-on baggage up to 7kg. All other ancillary costs outside of this are the responsibility of the entrant,
c. 3 nights accommodation at Sofitel Fiji Resort & Spa in a Luxury Waitui King Room with all room inclusions including daily breakfast for 2 adults from Monday 24th June – Thursday 27th June 2024,
d. A resort credit of FJ$250 per adult per day for Monday 24th June, Tuesday 25th June and Wednesday 26th June 2024,
e. Return transfers from Nadi International Airport to Sofitel Fiji Resort & Spa for 2 adults.
ii. Prizes are offered on a ‘NO EXCHANGE NO REFUND’ basis therefore prizes are non-transferable and non-refundable.
iii. Sofitel Fiji Resort & Spa does not accept any responsibility for unclaimed prizes.
iv. Prizes are non-transferable and cannot be redeemed for cash. All flights are subject to Fiji Airways’ conditions of carriage in effect at the time of booking.
v. Sofitel Fiji Resort & Spa reserves the right to substitute prizes of equal or greater value at any time.
vi. Winner shall be responsible for any costs and expenses related to the refusal of passage and or entry/exit requirements to or from Fiji by Winner and their guest. Winner and their guest must be medically fit to travel.
vii. Prize excludes travel insurance.
viii. Winner bears responsibility for the cost of domestic travel, including for their guest, to reach the nominated departure point in Australia or New Zealand.
ix. Winner is responsible for the payment of all taxes levied on, or in connection with, the prize and their use of it, including any taxes on their income.
x. Prizes may not be used in combination with any other ongoing offers, promotions, contests or discounts.
8. TERMS OF ENTRY
i. Sofitel Fiji Resort & Spa reserves the right to disqualify any Participant who, in its sole and absolute discretion, is not eligible to participate in the Contest.
ii. Sofitel Fiji Resort & Spa has the sole right to withdraw/edit any aspect of the Contest at its discretion and/or alter the terms and conditions without prior notice.
iii. Entries may only be submitted by individual participants. Participants may not submit entries for any person other than themselves, regardless of whether or not the Participant has submitted their own entry. Entries not submitted in accordance with the terms and conditions herewith shall not be considered in the Contest, and Sofitel Fiji Resort & Spa bears no responsibility for any such entries.
iv. Sofitel Fiji Resort & Spa has the right to use any content shared by the user for promotional purposes of the contest.
v. All entries become the exclusive property of Sofitel Fiji Resort & Spa and will not be returned.
vi. Sofitel Fiji Resort & Spa reserves the right to disqualify any participant, for any reason, in its sole discretion.
vii. Neither Sofitel Fiji Resort & Spa nor any of their respective parents, subsidiaries, affiliates and each of their respective officers, directors, shareholders, agents and employees, nor any Internet access providers (collectively “Released Parties”) are responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, lost/delayed/misdirected mail, omission, interruption, deletion, defect, line failure of any network, computer equipment, software or any combination thereof, or for late, lost, damaged, misdirected, incorrect or incomplete entry.
viii. If, for any reason, any aspect of this Contest is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of Sofitel Fiji Resort & Spa which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sofitel Fiji Resort & Spa may in its sole discretion cancel, terminate, modify or suspend this Contest or invalidate any affected submissions.
ix. Sofitel Fiji Resort & Spa may, in its sole discretion, disqualify any submissions and prohibit further participation in this Contest by any person who tampers with or benefits from any tampering with the submission process or with the operation of this Contest or acts in violation of these terms and conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
9. INTELLECTUAL PROPERTY, COMMUNICATION & PUBLICITY
i. Acceptance of the prize shall constitute the Winner’s agreement and consent for Sofitel Fiji Resort & Spa to use the Winner’s name, likeness, photo, interview, and/or prize information (including, without limitation, city of residence) in connection with the Contest for promotional, advertising or other purposes, in any manner, worldwide, in any and all media, whether now known or hereafter devised, including the internet, without limitation and without further payment, notification, permission or consideration.
10. RELEASE AND INDEMNITY
i. By participating, Participant hereby releases Sofitel Fiji Resort & Spa, from any and all liability for losses, harm, damage, injury, costs and expenses, including without limitation, property damage, personal injury and/or death arising from participating in the Contest, any Contest-related activity, and/or acceptance, receipt, possession or use/misuse of any prize, and for any claim or causes of action based on publicity rights, defamation or invasion of privacy to the extent permitted by applicable law.
11. EXCLUSION OF LIABILITY OF THE ORGANIZING COMPANY
i. Sofitel Fiji Resort & Spa reserves the right to suspend, postpone, extend or cancel the Contest without prior notice in the event of force majeure, following notification by all appropriate means. It shall not be held liable for doing so.
ii. Sofitel Fiji Resort & Spa may not be held liable for any disruptions to internet or electricity networks, incorrect use of the internet, failure of receiving equipment or any other incident affecting the smooth running of the Contest that could prevent a user from taking part before the deadline.
iii. Participants are responsible for taking all the necessary steps to protect their own data and/or software stored on their computer equipment against any attacks. Participants are fully responsible for their own connection to the page and their participation in the Contest. Any Participant attempting to tamper with the computer system of the Contest in any way whatsoever in order to win or to attempt to win will be disqualified from the Contest. In addition, Sofitel Fiji Resort & Spa reserves the right to take legal action against anyone who has cheated or attempted to do so.
iv. Sofitel Fiji Resort & Spa may not be held liable for any damage or injury of any kind due to: Malfunction of the website, computer errors or viruses or other problems that may cause damage; Following events having the characteristics of force majeure (strike, bad weather, war, attack) that partially or totally deprive the winners of their prize; Following any incident taking place to the winners during the enjoyment of their prize.
v. Sofitel Fiji Resort & Spa cannot be held liable for the rejection of any participation that does not comply with all the provisions of these rules.
12. APPLICABLE LAW & COMPETENT JURISDICTION
i. These rules are governed by and subject to the provisions of Fiji law, without prejudice to any mandatory protective provisions that may apply in the Participant’s country of residence. Any disputes will be subject to the exclusive jurisdiction of the courts of Fiji.
ii. These rules are written in English. In the event of a contradiction with any foreign language version, the provisions of the English version will prevail.
13. GENERAL
i. Sofitel Fiji Resort & Spa’s decision in respect of all matters to do with the Contest will be final and without appeal.
ii. Sofitel Fiji Resort & Spa reserves the right to hold, void, suspend, cancel, or amend the Contest, Contest Rules and/or Prizes at any time.
iii. Entrants are responsible for all costs, if any, incurred by entering the Contest.
iv. These are the official Contest Rules. If any provision of these Contest Rules is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
v. Headings are inserted for ease of reference and shall not affect interpretation.
